TERMS OF SERVICE
Last updated: September 7, 2026
OVERVIEW
Welcome to La Maison Orientale.
The terms “we”, “us” and “our” refer to La Maison Orientale. We operate this website and online store and provide the related information, content, features, products and services (the “Services”).
Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.
These Terms of Service (“Terms”), together with our Privacy Policy, Refund Policy and any other policies referred to on our website, set out the terms that apply when you access our website or purchase products from us.
Please read these Terms carefully before using our Services or placing an order.
Nothing in these Terms affects your statutory rights as a consumer under applicable UK law.
SECTION 1 - ELIGIBILITY AND ACCOUNTS
You may use our website only for lawful purposes.
When placing an order or creating an account, you must provide information that is accurate, current and complete.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account.
You must notify us promptly if you believe your account has been accessed or used without authorisation.
SECTION 2 - OUR PRODUCTS
We make reasonable efforts to display and describe our products accurately.
However, the appearance and colours of products may vary slightly depending on your device, screen settings, lighting and other factors.
Product photographs are provided to represent our products as accurately as reasonably possible but should be considered together with the written product description.
We may update product descriptions, availability, packaging or presentation from time to time.
Nothing in this section excludes or limits your statutory rights in relation to goods that are faulty, not as described or otherwise fail to conform to the contract.
SECTION 3 - ORDERS AND CONTRACT FORMATION
When you place an order through our website, you are making an offer to purchase the products in your order.
After receiving your order, we may send you an acknowledgement confirming that we have received it. An acknowledgement does not necessarily mean that your order has been accepted.
A contract between you and La Maison Orientale is formed when we confirm acceptance of your order, for example by sending an order confirmation or dispatch confirmation, depending on our checkout process.
We reserve the right to decline or cancel an order before acceptance where reasonably necessary, including where:
• A product is unavailable.
• There is an obvious pricing or product information error.
• Payment cannot be authorised.
• We reasonably suspect fraud or unauthorised activity.
• We cannot deliver to the address provided.
• Applicable law prevents us from fulfilling the order.
If we cancel an order after payment has been taken, we will refund the amount due to you.
Please review your order carefully before submitting it.
Your rights to cancel or return an order are explained in our Refund & Returns Policy.
SECTION 4 - PRICES, TAXES AND PAYMENT
Prices displayed on our website are shown in the currency applicable to the market you are shopping in.
Where required by applicable law, prices displayed to consumers will include applicable taxes such as VAT.
Delivery charges and any other applicable charges will be clearly communicated before you complete your purchase.
For international orders, additional customs duties, import taxes or other charges may apply depending on the destination country. Where these are not collected by us at checkout, you may be responsible for paying them to the relevant authority or carrier.
We may change our prices at any time, but changes will not affect orders that we have already accepted.
If we discover an obvious pricing error, we may contact you before accepting or fulfilling the affected order.
Payments are processed through Shopify and/or our authorised payment service providers.
You confirm that you are authorised to use the payment method provided for your purchase.
SECTION 5 - DELIVERY
We will provide an estimated delivery timeframe where available.
Delivery dates and times are estimates unless we expressly agree otherwise.
We will make reasonable efforts to deliver your order within the estimated timeframe.
If delivery is delayed, your rights will be determined in accordance with applicable consumer law.
For UK consumer orders, risk in the goods generally passes to you when the goods come into your physical possession or the possession of a person identified by you to receive them.
If you arrange your own carrier independently and that carrier was not offered by us, different rules may apply.
Please ensure that the delivery information you provide is complete and accurate.
SECTION 6 - CANCELLATIONS, RETURNS AND REFUNDS
Your rights relating to cancellations, returns, exchanges and refunds are set out in our Refund & Returns Policy.
For eligible distance purchases by UK consumers, you generally have a statutory right to cancel within 14 days after receiving the goods, subject to applicable exceptions.
La Maison Orientale also offers a voluntary 30-day return policy subject to the conditions set out in our Refund & Returns Policy.
Nothing in our voluntary return policy limits your statutory consumer rights.
SECTION 7 - FAULTY OR MISDESCRIBED GOODS
Products supplied by us must meet the standards required by applicable consumer law.
If a product is faulty, damaged, not as described, or otherwise does not conform to the contract, you may have statutory rights to a repair, replacement, price reduction or refund depending on the circumstances.
Nothing in these Terms or any other store policy is intended to exclude or restrict those statutory rights.
SECTION 8 - INTELLECTUAL PROPERTY
Unless otherwise stated, the content available through our Services, including our branding, trade names, logos, product photography, graphics, text, design elements, videos and other original materials, is owned by or licensed to La Maison Orientale and is protected by applicable intellectual property laws.
You may access and use our website for your personal, non-commercial use.
You must not reproduce, copy, distribute, modify, republish, commercially exploit or otherwise use protected content without our prior permission, except where permitted by law.
“La Maison Orientale” and associated logos, designs and brand elements may be trademarks or other protected intellectual property of La Maison Orientale or their respective owners.
Third-party trademarks remain the property of their respective owners.
SECTION 9 - THIRD-PARTY SERVICES AND LINKS
Our Services may contain links to third-party websites or use services provided by third parties, including payment, delivery, analytics and ecommerce service providers.
We are not responsible for the content, privacy practices or independent services of third-party websites that we do not control.
Before using third-party services or websites, you should review their applicable terms and privacy information.
SECTION 10 - SHOPIFY
Our store is powered by Shopify.
Shopify provides the ecommerce technology that enables us to operate our online store.
Products purchased through our store are sold by La Maison Orientale and not by Shopify.
Your use of certain Shopify functionality may also be subject to Shopify’s applicable terms and privacy practices.
SECTION 11 - PRIVACY AND PERSONAL INFORMATION
We process personal information in accordance with our Privacy Policy and applicable data protection law.
Please review our Privacy Policy for information about the personal information we collect, how we use it, who we share it with and your rights.
SECTION 12 - REVIEWS AND USER CONTENT
If you submit a review, comment, photograph or other content to us or through our website, you confirm that you have the right to provide that content and that it does not violate applicable law or the rights of another person.
You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display content you voluntarily submit for purposes connected with operating, promoting and improving our Services.
Where required by law, we will identify incentivised or sponsored reviews appropriately.
We reserve the right to remove content that is unlawful, abusive, misleading, fraudulent, infringing or otherwise inappropriate.
SECTION 13 - ERRORS AND AVAILABILITY
We make reasonable efforts to ensure that information displayed on our website is accurate.
Occasionally, information relating to product descriptions, prices, promotions, availability, delivery or other matters may contain an error.
Where an error occurs, we may correct the information and, where appropriate, contact you regarding an affected order.
Nothing in this section limits your statutory consumer rights.
SECTION 14 - PROHIBITED USES
You must not use our Services:
• For unlawful or fraudulent purposes.
• To infringe intellectual property or other legal rights.
• To transmit malicious software or harmful code.
• To interfere with the security or operation of the website.
• To collect personal information about others unlawfully.
• To impersonate another person or organisation.
• To send spam or other unauthorised communications.
• To attempt to gain unauthorised access to our systems.
• To use automated systems in a manner that materially disrupts, damages or places an unreasonable burden on our Services.
We may restrict or suspend access where reasonably necessary to protect our Services, customers or legal rights.
SECTION 15 - SUSPENSION AND TERMINATION
We may suspend or terminate access to an account where we reasonably believe that:
• These Terms have been materially breached.
• The account is being used fraudulently or unlawfully.
• The security of the account or our Services is at risk.
• We are required to do so by law.
Termination does not affect rights or obligations that arose before termination.
SECTION 16 - OUR RESPONSIBILITY TO YOU
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
If you use our products or Services primarily for business or commercial purposes, different limitations may apply to the extent permitted by law.
Nothing in this section affects your statutory consumer rights.
SECTION 17 - EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be responsible for delays or failures caused by events outside our reasonable control.
If such an event significantly affects our ability to fulfil your order, we will take reasonable steps to minimise the impact and will contact you where appropriate.
Your statutory rights in relation to delayed or undelivered goods remain unaffected.
SECTION 18 - SEVERABILITY
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue in full force and effect.
SECTION 19 - WAIVER
If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
Any waiver applies only to the particular circumstances in which it is given.
SECTION 20 - CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices or legal requirements.
The latest version will be published on this website together with the date it was last updated.
Changes will not retrospectively alter the terms applicable to an order that has already been accepted unless required by law or agreed with you.
SECTION 21 - GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory protections available under the laws applicable where you live.
Nothing in these Terms deprives you of any mandatory consumer protections that apply to you.
Any dispute may be brought before the courts having jurisdiction under applicable law.
